1. PAYMENT

1 Once the Quote has been accepted the quote will include a materials deposit, This Deposit needs to be paid 7 days before project start date.

2 IF the project has multiple stages each remaining balance must be paid in full before commencing latter stages of the project

3 Upon receiving final payment material and the service warranty will be handed over to the client completing the agreement




  1. FINAL PAYMENT

Final Payment will be due (7) days after the final invoice has been sent.

 

  1. PROPERTY LINES

When required PTR property services may request Boundary line plans,

lines and all subsurface utility and service line plans, including but not limited to electrical, telephone and gas lines and water

information and shall not be liable for damages or costs resulting from any errors or omissions in that regard.


  1. BUILDING MATERIALS

1 PTR property services ltd Shell have full control the work and responsible for the construction of the project and all related tasks, PTR property services will comply with all Nz Laws, standards, and building codes and

legislation. PTR property services ltd agrees to remove all debris and leave the premises in cleaning tidy condition, unless otherwise organised by the client.

  1. CONCEALED PHYSICAL CONDITIONS

1 If a project requires variation to the original quote price IE additional equipment or materials both parties must come to a Written agreement confirming acceptance of the variation Projects will be placed on hold until an agreement can be meet

2 It is the customers responsibility to ensure the boundary is marked correctly before work commences if any costs occur due to incorrect boundary lines will be treated as a variation to the original quote



  1. PTR property services ltd COMPLIANCE

If the CLIENT so terminates the Agreement, PTR property services shall be entitled to be paid for the value of all Work

performed to the date of the termination.


  1. LIABILITY INSURANCE

PTR property services Is covered by Limited liability insurance Up to the value of 1,000,000


  1. CHANGES IN THE WORK

Changes in the Work can be requested by the CLIENT In writing and the price for a change in the Work must be agreed to in writing.

If the CLIENT and PTR property services LTD cannot agree to a price for the change in the quote, then the project will be put on hold and third-party services may be called upon.


  1. INVOICES AND OVERDUE INVOICES

1 Payments for Variations to the quote will be made separately on a New invoice with a detailed description of the changes in Job scope and the additional costs involved.

Invoices are to be paid within 7 days after issuing unless agreed upon, ALL OVERDUE invoices that exceed the 7-day period will incur a 2% interest rate per 7-day period Until the balance is paid in full.



  1. PAYMENT METHOD

All the prices quoted are based on cash/bank transfer payments.

  1. CLIENTS INSOLVENCY

Should the CLIENT be insolvent, be adjudged bankrupt or default in any payment described in Articles 1, 2 or 10, above,

PTR property services ltd without further notice to the CLIENT may stop performance of the Work or terminate this Agreement such that

PTR property services ltd obligations hereunder will be suspended or terminated without limitation, the CLIENT will have the sole responsibility to monitor and manage the safety and condition of the Premises and PTR property services ltd shall be entitled to be paid

for the value of all Work performed to the date of the termination.


  1. WARRANTIES

1 PTR property services ltd warrants the Work against defects in workmanship and materials for a period of one (1) year for Services Provided.

2 All Hardscape installs including Fencing retaining walls (5 Years)

3 Garden landscape (Garden boxing, edging and paver paths and walkways) (2 years)

4 Decking, Pergola Building projects (10 Years)

5 The warranty takes effect from when PTR property services Submits the final invoice and the total project        balance is paid in full

6 The warranty does not apply if the client has defaulted on the agreement or if from the effects of normal corrosion, wear and tear, damage or deficiencies created by faulty operations or maintenance required by the client, This includes (maintain the water requirements of plants shrubs and grass).

7 Once the client has provided PTR property services with notice of a warranty claim under this agreement, PTR property services ltd Has 30 days to respond to the warranty


  1. RESOLUTION OF DISPUTES

Any dispute or difference which may arise between the parties concerning the interpretation of this Agreement or in relation to

any matter arising under this Agreement, which cannot be settled in good faith between the parties, shall be

referred to arbitration under the Arbitration Act 1996
